1. Purpose
These general terms and conditions of sale (GTC) govern online sales concluded between SARL Les Armateurs de Rhum de Saint-Malo (hereinafter "the Seller") and any private consumer (hereinafter "the Customer") via the Seller's commercial website. They apply to the purchase of alcoholic beverages (rum, punches, liqueurs, spirits, and derivatives). These GTC are effective as of September 5, 2025, and replace any previous version.
2. Protection of minors and responsible consumption
In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcohol to minors is prohibited. By confirming their order, the Customer declares that they are over 18 years of age. The Seller encourages responsible and moderate consumption.
Health warning: Alcohol consumption is not recommended for pregnant or breastfeeding women, or for people with health problems (particularly cardiovascular problems).
3. Products
The essential characteristics of the products are presented on the website. The photographs are not contractual.
Availability: product offers are valid while stocks last. If a product is unavailable after an order has been placed, the Seller will inform the Customer, who may cancel their order and obtain a refund.
4. Price
The prices displayed on the website are in euros, including all taxes, excluding delivery costs. Delivery costs are specified before final confirmation of the order.
In the event of promotions or special offers, these are only valid for the duration indicated and while stocks last.
5. Orders
Confirmation of the order implies unconditional acceptance of these Terms and Conditions. Electronic confirmation of the order constitutes an electronic signature with the same value as a handwritten signature between the Seller and the Customer.
The Seller reserves the right to refuse any order in the event of a previous dispute with the Customer or suspicion of fraud.
6. Payment
Payment is made in full at the time of ordering, by credit card, bank transfer, or any other method offered on the website. The order is only considered final after payment has been confirmed.
7. Delivery
Products are delivered to the address specified by the Customer. Delivery times are specified when the order is placed. In the event of a delay exceeding 30 days from the announced date, the Customer may cancel the order and obtain a refund. The transfer of risk occurs upon actual delivery to the Customer.
Upon receipt of the order, the Customer is required to check the condition of the package and the products.
In the event of any apparent anomaly (damaged package, missing product, broken bottle, etc.), the Customer must immediately issue clear and precise reservations to the carrier, then inform the Seller within 48 hours by email at co*****@*************um.fr.
In the absence of reservations made to the carrier, and unless proven otherwise by the Customer, the order will be deemed to have been delivered in good condition.
In the event that a product is delivered broken or missing, the Seller will, after verification, either replace or refund the product in question.
8. Pre-orders
Some products may be available for pre-order. In this case, the delivery time will be indicated when the order is confirmed. Payment will be taken immediately. If the product is unavailable or there is a delay longer than the stated delivery time, the Customer may cancel their order and obtain a refund.
9. Withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify their reasons or pay any penalties.
– The Customer shall inform the Seller of their decision using the standard withdrawal form available in the appendix or by any other unambiguous statement.
– Products must be returned in their original condition and unopened, at the Customer's expense.
– Refunds will be issued within 14 days of receipt of the returned products.
⚠️ Bottles that have been opened, unsealed, or damaged by the Customer cannot be returned (Article L.221-28 of the Consumer Code).
10. Legal warranties
All products are covered by the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of non-conformity or hidden defects, the Customer may request repair, replacement, or reimbursement.
11. Liability
The Seller shall not be held liable for any damage resulting from misuse of the purchased product.
12. Personal data
The information collected during the ordering process is necessary for processing the order and delivering the goods. The Customer has the right to access, rectify, and delete their data, in accordance with the GDPR, by contacting: co*****@*************um.fr. The full privacy policy is available on the website.
13. Mediation and dispute resolution
If you have been unable to resolve your dispute after sending us a written complaint (by mail or email), dated, outlining the circumstances that gave rise to the dispute and what you are claiming, you may refer the matter to the consumer mediator designated below if you have received a negative written response from us or no response two months after sending your complaint.
In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, our company has set up a consumer mediation system. The mediation entity selected is:

The applicable law is French law. Any unresolved dispute will be brought before the competent courts in accordance with the rules of common law.
14. Intellectual property
All elements of the website (text, images, logos) are protected by copyright and remain the exclusive property of the Seller.
